Immigration Procedures
Timelines depend entirely on current government processing backlogs. The New York-area immigration courts carry some of the heaviest caseloads in the nation. We provide an estimated timeline based on current data during your consultation, but we cannot guarantee processing speeds—they are outside any attorney's control.
It depends on your situation and family ties. Immediate relatives (spouses, parents, and unmarried children under 21) of U.S. citizens may be able to adjust status despite an overstay. Other categories face significant bars—including 3-year and 10-year unlawful presence penalties. You must consult with us directly to determine your eligibility.
Do not ignore a Notice to Appear (NTA). You must attend all scheduled hearings at the immigration court. We can evaluate your case to determine if you qualify for relief from removal, such as Cancellation of Removal, Asylum, or Adjustment of Status. Failure to appear will result in a removal order issued in your absence.
